Conditions of Enrolment

k English Academy (NEW SPARK) reserves the right to accept or decline student applications to ensure an optimal learning environment within the institution.

Enrolment Procedures

NEW SPARK will begin processing the application as soon as the completed Enrolment Form and all required supporting documents are received. Placement on a course is provisional upon the student completing the placement test. Selection for the course is subject to the applicant possessing the necessary language skills to participate in the programme and the availability of sufficient spaces to accommodate all candidates. Entry requirements vary depending on the specific course applied for. Upon acceptance into the programme, students will receive a student handbook, assistance with completing any required Ministry of Education forms, and a guided tour of NEW SPARK. Additionally, they will be informed of the time and location of their first lesson.

Payment of Fees

All tuition, accommodation, enrolment fee and other fees are payable in advance or by the specified due date. A conditional offer of place at NEW SPARK cannot be confirmed until all tuition, accommodation, insurance and airport pick-up (if required) fees have been received in full by NEW SPARK. All transfers must be clearly referenced with our student number (e.g. NSEA2503001).

Evidence of payment / electronic transfer of funds must be forwarded to NEW SPARK Student Fee Protection

NEW SPARK has an agreement with Public Trust to protect students' fees. Under this agreement, all fees paid by students are held in a trust account managed by Public Trust. The funds are then transferred to NEW SPARK on a monthly, pro rata basis, and in arrears. This arrangement safeguards students' fees in the event that NEW SPARK closes.

Fees will not be transferred to NEW SPARK until seven days after the course begins. This ensures that if a student withdraws from NEW SPARK within the first seven days of the course start date, their fees remain protected and can be refunded.

Withdrawals and Refunds 

Students who wish to withdraw from a programme must complete a Withdrawal Form available from the Administrator or Student Service Officer.

When students withdraw from NEW SPARK, Immigration New Zealand will be advised. The refund policy will be as below (according to NZQA’s Student Fee Refund Policy that can be found on https://www2.nzqa.govt.nz/about-us/protect-students/student-fee-protection/information-for-learners/student-withdrawals-and-refunds/#e10024_heading1) :

·  Courses under 5 weeks: If a student withdraws within the first 2 days of the commencement of the course, he or she is entitled to a refund of 50% of total fees paid.

·  No refund is normally made in the case of withdrawals more than 2 days after the course commencement date. The only applications for a refund or remission of tuition fees, which will be considered after 2 days from the commencement date of a programme, will be those arising from medical reasons, or exceptional circumstances recognized by the Director of NEW SPARK.

·  Courses 5 weeks or more but less than 3 months:  If a student withdraws within the first 5 days of the commencement of the course, he or she is entitled to a refund of 75% of the total fees paid.

·  No refund is normally made in the case of withdrawals more than 5 days after the course commencement date. The only applications for a refund or remission of tuition fees, which will be considered after 5 days from the commencement date of a course, will be those arising from medical reasons, or exceptional circumstances recognized by the Director of NEW SPARK.

·  Courses 3 months or more: If a student withdraws within 10 days of the commencement of the course, he or she is entitled to a full refund less deduction for costs incurred by NEW SPARK, up to a maximum of 25% of fees paid.

·  No refund is normally made in the case of withdrawals more than 10 days after the course commencement date. The only applications for a refund or remission of tuition fees, which will be considered after 10 days from the commencement date of a course, will be those arising from medical reasons, or in exceptional circumstances as recognized by the Director of NEW SPARK.

Additional to the NZQA’s Student Fee Refund Policy, the following policies are imposed by NEW SPARK:

·  The above policy applies for students who are not able to start the course on the specified start date and who submit a request for withdrawal.

·  If the student is expelled from the course (due to low attendance or due to not starting the course on the specified start date), no fees will be refunded.

Note: The total fees mentioned above include all fees paid to NEW SPARK, excluding accommodation fees. Any accommodation fees paid to NEW SPARK, and placed into the Public Trust account will be refunded to the student. This excludes the homestay placement fee which will be retained by NEW SPARK.

Homestay Accommodation

Students under the age of 18 must stay with a Homestay if they are not living with their parents.  In cases where NEW SPARK assists students in the finding of accommodation, NEW SPARK acts only as an agent for accommodation and cannot be held responsible for any accident, illness or damage to a student or property, which may happen during the student’s stay. The student is responsible for providing their own insurance to cover these liabilities.  

Student Disciplinary Procedure

Students are required to maintain a tidy, professional, and hygienic appearance at all times while attending New Spark English Academy.

If a student exhibits disruptive or uncooperative behaviour during the course, a first verbal warning will be issued. Should the behaviour persist, a second verbal warning will follow. In the event of a third breach of policy, a written warning will be provided. If the student continues to engage in the misconduct after these warnings, NEW SPARK reserves the right, at its discretion, to suspend or expel the student.

Immediate termination of enrolment will apply in cases of serious misconduct, which includes, but is not limited to, wilful damage to NEW SPARK’s physical or intellectual property, theft, unauthorized access to the NEW SPARK network, inappropriate Internet usage, intoxication, or possession or use of illegal substances. In such cases, Immigration authorities will be notified that the student is no longer enrolled at NEW SPARK.

If a student causes harm, behaves abusively, or engages in physical aggression toward staff or fellow students, they will be suspended pending an investigation. The suspension period will allow for a thorough examination of the incident. Should the behaviour be determined to be of a serious nature, the student will be expelled from NEW SPARK.

Any student found to be in violation of New Zealand law will be subject to immediate expulsion.

Infringement of Rules or Laws

If a student does not comply with NEW SPARK rules and the laws of New Zealand, NEW SPARK reserves the right to suspend or expel the student. No refund of fees will be made.

Attendance

Students are required to attend all classes and be punctual at all times. Regular attendance is essential, and an overall attendance rate of at least 90% must be maintained.

If a student is frequently absent and fails to meet the attendance requirement (falling below 90%), NEW SPARK will issue a verbal warning. Should attendance not improve following this warning, a first formal warning will be issued via letter or email. If the student’s attendance continues to decline and remains below 90% after the first warning, a second formal warning will be issued via letter or text. If, after two warnings, the student’s overall attendance does not improve and remains below 90%, NEW SPARK will proceed with the termination of enrolment. This will be carried out by submitting a Termination of Enrolment Form on Immigration New Zealand website: Immigration New Zealand – Student Enrolment Termination.

Liability

NEW SPARK shall not be held responsible for any sickness, injury, damage, or loss incurred during participation in academy activities. It is the sole responsibility of the student to arrange appropriate personal insurance coverage.  NEW SPARK reserves the right to modify its fees at any time without prior notice. NEW SPARK shall not be liable in the event that any published courses cannot be offered for any reason.

Education Code of Practice

NEW SPARK has agreed to observe and be bound by The Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021. The Code of Practice has set high standards for the care and protection of all students and the aim of the code is to ensure all students are being taken good care of and are safe while studying in New Zealand. Copies of the code are available from the New Zealand Qualifications Authority website at https://www2.nzqa.govt.nz/assets/Tertiary/The-Code/pastoral-care-code-of-practice-2021-english.pdf. Hard copies of the Education Code of Practice are available in each classroom and in the Principal’s Office.

Immigration

Full details of visa and permit requirements, advice on rights to employment in New Zealand while studying, and reporting requirements are available through Immigration New Zealand, and can be viewed on their website at www.immigration.govt.nz

Eligibility For Health Services

Most international students are not entitled to publicly funded health services while in New Zealand.  If you receive medical treatment during your visit, you may be liable for the full costs of that treatment.  Full details on entitlements to publicly funded health services are available through the Ministry of Health, and can be viewed on their website at www.health.govt.nz

Accident Insurance

The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents, and temporary visitors to New Zealand, but you may still be liable for all other medical and related costs.  Further information can be viewed on the ACC website at www.acc.co.nz

Medical and Travel Insurance

International students studying in New Zealand are not entitled to free medical care. International students must have appropriate and current medical and travel insurance while studying in New Zealand.

NEW SPARK provides two Student Insurance policies for students to choose from, which are Southern Cross International Student Travel Insurance and Uni-Care NZ Student Plan Insurance. Our Student Support Officer will provide you with more information of the insurance plans and policies of these two companies and how to buy them accordingly. The insurance should cover to or exceed the current visa period. If you wish to provide your own insurance, you must provide a copy of the insurance policy, translated into English, to NEW SPARK for verification of acceptable cover.
